Bond & Being Terms of Service

§ 1. General provisions

  1. These Terms set out the rules for using the Bond & Being online store available at bondandbeing.com (the Store).
  2. The Store is operated by Dominik Zaręba, ul. Koralowa 13, 96-515 Paprotnia, Mazowieckie Voivodeship, Poland; email: info@bondandbeing.com; phone: +48 721 903 005 (the Seller).
  3. The Seller conducts unregistered business activity under Art. 5(1) of the Polish Entrepreneurs' Law Act of 6 March 2018. This does not release the Seller from obligations towards consumers — all consumer rights described in these Terms apply to the Customer in full.
  4. These Terms are continuously available on the Store website in a form that allows them to be obtained, reproduced and stored.
  5. Contact with the Seller is by email, phone or contact form. The cost of a phone call corresponds to the Customer's standard operator rate.

§ 2. Definitions

  • Customer – a natural person, legal person or organisational unit making a purchase in the Store.
  • Consumer – a natural person making a purchase not directly related to their business or professional activity (Art. 221 of the Polish Civil Code).
  • Entrepreneur with consumer rights – a natural person concluding a contract directly related to their business activity, where the content of the contract shows that it is not of a professional nature for them. Such a person is entitled to the rights described in § 9 and § 10.
  • Goods – a movable item offered in the Store.
  • Contract – a distance contract for the sale of Goods concluded between the Customer and the Seller.
  • Account – a set of resources in the Store system storing the Customer's data and order history.

§ 3. Technical requirements

  1. To use the Store you need: a device with internet access, an up-to-date web browser with JavaScript and cookies enabled, and an active email address.
  2. The Seller is not liable for disruptions to the Store caused by force majeure, failure of the Customer's equipment or unauthorised third-party interference.
  3. The Customer must not supply content of an unlawful nature.

§ 4. Services provided electronically

  1. The Seller provides the following services free of charge: maintaining an Account, the order form, the contact form and the newsletter (with the Customer's consent).
  2. The contract for maintaining an Account is concluded for an indefinite period. The Customer may terminate it at any time, without giving a reason, by sending a message to info@bondandbeing.com or by deleting the Account in the customer panel.
  3. The Customer may withdraw newsletter consent at any time — via the link in the footer of the message or by email.

§ 5. Prices and price information

  1. Prices in the Store are given in Polish złoty (PLN) and are gross prices (they include applicable taxes).
  2. The price does not include delivery costs, which are shown separately before the order is placed.
  3. Where the price of Goods is reduced, the Seller displays next to the promotional price the lowest price of those Goods from the 30 days preceding the reduction, in accordance with Art. 4(2) of the Polish Act on informing about the prices of goods and services.
  4. The price shown in the order summary at the moment the order is placed is binding on the parties.
  5. The Seller does not apply individual price adjustment based on automated decision-making or profiling.

§ 6. Placing an order and concluding the contract

  1. Orders may be placed 24 hours a day, 7 days a week.
  2. Order process: select Goods → add to cart → enter delivery and payment details → read these Terms → click the “Buy and pay” button.
  3. Clicking “Buy and pay” means placing an order with an obligation to pay.
  4. After placing an order, the Customer receives confirmation of its acceptance at the email address provided. The Contract is concluded when this confirmation is delivered.
  5. The Seller records and makes available to the Customer the content of the concluded Contract by sending the confirmation by email.
  6. If fulfilling the order proves impossible (e.g. the Goods are unavailable), the Seller will inform the Customer promptly and refund the full payment received within 14 days.

§ 7. Payment methods and deadlines

  1. Available payment methods: payment card, BLIK, fast online transfer, Apple Pay / Google Pay, PayPal, Shop Pay — as shown at checkout.
  2. Payments are handled by external payment providers. The Seller does not store full payment card details.
  3. The Customer is obliged to pay within 3 days of concluding the Contract. Failure to pay within this period means the order is cancelled.
  4. For every order the Seller issues a proof of sale (receipt) sent electronically. The Seller is not an active VAT payer and therefore does not issue VAT invoices.

§ 8. Order fulfilment and delivery

§ 9. Right of withdrawal

§ 10. Complaints — lack of conformity of Goods with the contract

§ 11. Product reviews

  1. The Seller allows reviews of Goods to be posted.
  2. The Seller verifies whether reviews come from Customers who actually purchased the Goods — by linking the review to the order number in the Store system.
  3. The Seller does not post sponsored reviews and does not remove negative reviews because of their content. Only unlawful, abusive, spam or off-topic reviews may be removed.

§ 12. Complaints regarding electronic services

  1. Complaints regarding the operation of the Store should be sent to info@bondandbeing.com.
  2. The Seller considers a complaint within 14 days of receiving it.

§ 13. Out-of-court dispute resolution

  1. A Consumer may use out-of-court methods of handling complaints and pursuing claims, in particular:
    • apply to a permanent consumer arbitration court operating at the Regional Inspectorate of Trade Inspection,
    • apply to the Regional Inspector of Trade Inspection to initiate mediation proceedings,
    • obtain free assistance from a district (municipal) consumer ombudsman or a social organisation dealing with consumer protection.
  2. Detailed information is available on the website of the Polish Office of Competition and Consumer Protection: uokik.gov.pl.
  3. Using out-of-court dispute resolution is voluntary and requires the consent of both parties.
  4. Consumers resident in another EU country may seek help from the European Consumer Centres Network (ECC-Net): konsument.gov.pl.

§ 14. Personal data

The rules for processing personal data are set out in the Privacy Policy available on the Store website.

§ 15. Final provisions

  1. Matters not governed by these Terms are subject to Polish law, in particular the Civil Code, the Consumer Rights Act and the Act on providing services by electronic means.
  2. The choice of Polish law does not deprive the Consumer of the protection afforded by the mandatory provisions of the law of their country of habitual residence (Art. 6 of the Rome I Regulation).
  3. Disputes with Customers who are not Consumers are settled by the court having jurisdiction over the Seller's place of residence.
  4. The Seller may amend these Terms for important reasons (changes in legislation, changes to payment or delivery methods, changes to the scope of services). Customers holding an Account will be informed of any change by email 14 days in advance. Orders placed before the changes take effect are fulfilled under the previous rules.
  5. No provision of these Terms limits the Consumer's rights under mandatory provisions of law. In the event of conflict, those provisions prevail.
